With the passing of the 2018 Farm Bill Legislation, CBD became federally legal if the plant contains less than 0.3% THC. Industrial hemp (cannabis plant) contains less than 0.3% so hemp-derived CBD products are federally legal. One the other hand, Marijuana (cannabis sativa) contains more than 0.3% in the plant, so CBD derived from cannabis sativa is not legal under federal law.
However, these regulations vary across the country as it relates to CBD topicals or CBD edibles. Currently, Washington State’s Department of Agriculture states that CBD is not allowed as a food ingredient. For any edible products that use CBD, these items are only allowed to be sold in state licensed marijuana retail stores.
